Terms of sale

PRICE LIST:
The prices are in Euro, for a bottle of 75cl, except contrary indication for the Noble-rotted Sweet Wine bottled in 50cl bottles. The price mentioned on product description does not include delivery charges, except concerning the Discovery Pack. The price indicated in the order confirmation is the final price, all taxes included, and comprising the VAT at the rate in effect. This price includes products price; handling, packing, keeping and delivery charges. Pictures and illustrations are not contractual. Product tags are likely to evolve with the vintages.

PAYMENT :
Products settlement can be made by cheque, transfer or credit card for deliveries in France (except in Corsica and in Breton Islands). Products settlement can be made by cheque or transfer for deliveries in Corsica, in Breton Islands and in the other countries of the European Union.
An invoice will be sent to the individual customer to his billing address.

The electronic payment is made on the secured website of la Banque Populaire of Duras (Cyberplus). The connexion to the site is secured by an encrypting SSL at 128 bits. Your credit card number will never pass through our website nor be known by our company.

The registering of the sale data on the banking system of payment is worth proof of the transaction. A message of the online boutique will be sent to the specified email address.

For more safety, we validate the payments to the bank only after having checked each order.

OWNERSHIP RESERVATIONS:
The goods remain the ownership of the Limited Liability Company Le Château La Petite Bertrande, until the integral settlement of the invoices.

STORAGE:
All our offers mean departure from our estate of Château La Petite Bertrande, at Saint Astier de Duras, company's head office.

DELIVERY & RECEIPT:
We currently deliver in France metropolitan and in the other countries of the European Union. Wines are packed in cardboard packs. The vintage year is mentioned only as a reference, and will be replaced by the following in case of change or selling out.

The minimum order is four packs, except regarding the Discovery Pack than can be sold alone.

The average times are specified on the commercial offer. The delivery is carried out, within the estimated period, by the direct delivery of the product to the initial recipient, or in case of absence, by an availability notice. The possible delays do not give the right to the purchaser to cancel the sale, to refuse the goods or to claim damages. The products always travel at the own risks of the recipient. Always check your parcel at the receipt. You have a 48-hour deadline to make reservations to the carrier in case of incomplete delivery or damage.

In the 7 days following the delivery, each recipient can send back at his expenses, the goods in their packing of origin, imperatively to the address indicated on the Delivery order. Refund will be carried out to the customer, as soon as the goods have been received by our warehouse, deduction of the transport charges and of the possible damaged products. (Article L 121-16 du Code de la Consommation)

LIMITING CLAUSE OF LIABILITY:
In any event, if the responsibility of the Limited Liability Company the Château La Petite Bertrande is engaged, this one is limited to the value of the blamed delivery.

CLAUSE OF JURIDICTION ATTRIBUTION:
In the event of litigation, the customer will address in priority to the company to obtain an amicable solution. In the absence of amicable solution, the Commercial Court of Marmande, France, is the only competent court, whatever the place of delivery and the accepted mode of payment.

LEGAL INFORMATION:
Under the terms of the ordinance n° 59-107 of January 7, 1959, that specifies the prohibition of alcohol sale to the minors "under sixteen " (Law n°74-631 of July 5, 1974), you engage by filling the purchase order to be 16 years old completed at the date of the order.
